1. Introduction

These Terms & Conditions (“Agreement”) govern your use of the products and services provided by Flowgent (“we,” “our,” “us”) as well as your interaction with our marketing systems. By engaging with our website, responding to our advertisements, opting into our SMS or email communications, or becoming a client, you agree to be bound by this Agreement.


2. Services

Flowgent provides marketing and automation services for service-based businesses including but not limited to:

Facebook and Instagram ad management, AI-generated ad creative, SMS, email, and voice-based lead nurturing, CRM and funnel setup using GoHighLevel, Lead qualification and appointment booking via AI voice agents

Service packages are tailored per client and may evolve over time based on performance and strategic needs.


3. Guarantee

We guarantee a minimum of 10 qualified listing appointments within 90 days. If this result is not met and the client has fully completed onboarding, granted all required access, and allowed ads to run without interruption, a full refund may be requested.


4. Onboarding & Responsibilities

To begin work, the client agrees to:

Complete all onboarding steps (ad account access, CRM setup, intake forms)

Respond to communications in a timely manner

Be present for scheduled onboarding and strategy calls

Review and approve ads prior to launch

Ensure their Meta Business account remains in good standing

Maintain a working email and phone number capable of receiving SMS

Delays due to client inaction may affect timeline or invalidate the guarantee.


5. Timeline

Once onboarding is finalized and we have full access, we aim to have your funnel, ads, automations, and AI voice assistant live within 7–10 business days.


6. Cancellation & Termination

After the initial 3-month period, services continue month-to-month and may be canceled with 7 days' written notice before the next billing date.


7. SMS & A2P 10DLC Compliance

Flowgent follows A2P 10DLC guidelines for all messaging. This includes:

Campaign registration with carriers for outbound SMS

Clear opt-in language on lead forms and ads

Use of STOP and HELP commands in messages

Consent tracking where applicable

Lead Outreach Disclosure:

By submitting your phone number through any Flowgent form or campaign, you consent to receive automated SMS messages from Flowgent for service updates, reminders, offers, and lead outreach.

Reply STOP to unsubscribe, HELP for assistance

Message & data rates may apply

We do not buy, sell, or share contact data and only message users who have expressed interest through direct or indirect opt-ins.


8. Ownership of Materials

All ad creatives, funnels, automations, and AI scripts developed by Flowgent remain the intellectual property of Flowgent unless otherwise agreed in writing. Upon termination, you may request an export of your contact data and booked appointments.


9. Confidentiality

Both parties agree to keep confidential any sensitive business, login credentials, strategy, or financial information shared throughout the engagement.


10. Limitation of Liability

Flowgent shall not be held liable for:

Ad performance fluctuations

Platform outages (Meta, GHL, AI tools, etc.)

Delays caused by client-side errors or missing information

Compliance issues caused by client-modified automations


11. Governing Law

This Agreement is governed by the laws of the State of Florida, without regard to its conflict of laws principles.
